Faculty Privilege and Academic Personnel Advisers

The Committee of Faculty Privilege and Academic Personnel Advisers was appointed on January 28, 2002 under the authority of By-law 44, which was revised by action of the Representative Assembly at its annual fall meeting in 2002.  The responsibilities of the members of this new committee are to advise members of the Faculty concerning personnel processes and procedures for appeal of personnel actions, and to provide them with independent assessments of whether a personnel action raises substantive issues for appeal.

 

The Committee met once on April 18, 2003, to inform itself about the new grounds and procedures for appealing administrative decisions on personnel actions.  Bylaw 45 (10/21/02) now provides  that the grounds for appeal may involve either matters of merit or procedure.  An Appeals Subcommittee of CAP (CAPAC) advises the Deans or Vice Provost on all appeals of personnel actions, and is independent of the both the Faculty Personnel Committees and the Oversight Subcommittee of CAP that considers personnel actions initially.  The Appeals Subcommittee is now required by By-Law 45 to address explicitly the issues raised on appeal.  Failure to do so is a procedural error that is that may be appealed to the Committee of Faculty Privilege and Tenure.

 

The Committee has received one request for advice from a member of the Faculty.
